Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Atlas Analytics LLC (“Postbye”, “we”, “us” or “our”), the operator of the Postbye website and design studio. They apply when you browse the site, subscribe to a monthly plan or hire us for a one-off project. By subscribing or accepting a project quote, you agree to these Terms and our Privacy Policy.

1. Who can subscribe

You must be at least 18 years old and able to enter into a contract, either for yourself or for the business you represent. You agree that the information you give us, including your name, email, billing details and business details, is accurate and that you are authorized to use the payment method you provide.

2. Monthly plans

Postbye offers three monthly design plans. By subscribing, you agree to the following:

• Prices. Starter costs $95 per month, Growth costs $145 per month and Studio costs $295 per month, in US dollars, plus any sales tax that applies.
• Automatic renewal. You are charged the monthly price of your plan on the day you subscribe. Your plan then renews automatically every month on the same calendar day (or the last day of a shorter month), and you authorize us to charge the monthly price to your saved payment method on each renewal date until you cancel.
• Reminders. We email you three days before each renewal with the date and amount of the next charge.
• Changing plans. You can move to another plan by emailing us. The new price applies from your next billing date, and the new plan’s features start on that date.
• How to cancel. You can cancel at any time, with no fee and no minimum term, by emailing team@postbye.ai from the address on your account. To avoid the next charge, cancel before your renewal date; email requests received by 11:59pm Eastern time on the day before the renewal date are honored.
• Effect of cancellation. After you cancel, no further charges are made. Your plan stays active until the end of the month you have already paid for, and we finish requests that are in progress during that time.
• Price changes. We will email you at least 30 days before any change to your plan’s monthly price takes effect. If you do not want to pay the new price, you can cancel before it applies.
• Failed payments. If a renewal charge fails, we will retry up to two more times over seven days and pause work on your queue meanwhile. If payment still fails, your plan ends.

3. Requests and turnaround

You send design requests by email. We work through your queue in the order you choose, with the number of active requests and the turnaround described for your plan on our Pricing page. Turnaround times are counted in business days, Monday to Friday excluding US federal holidays, and are typical times rather than guarantees. Large requests, such as a full website, are delivered in stages.

4. One-off projects

For one-off branding or web design projects we send a written quote with the scope, price, payment schedule and timeline. A project starts when you accept the quote and pay any deposit it sets out. Work outside the agreed scope is quoted separately before we start it.

5. Revisions and approval

We revise each design until you are happy with it, within the scope of the original request. A design is final when you approve it or when you have not replied with notes for 14 days after delivery.

6. Ownership of the work

Once the month or project concerned is paid in full, you own the final designs we deliver to you, together with the editable source files we created for them, and you may use, change and reproduce them however you like. Fonts, stock images and other third-party materials remain subject to their own licenses, which we tell you about when we use them. Until payment is made, all work remains the property of Atlas Analytics LLC. We may show finished work in our portfolio without naming your business, unless you ask us not to.

7. Your materials

You confirm that you have the right to use the logos, images, text and other materials you send us, and you remain their owner. You give us permission to use them only to carry out your requests.

8. Confidentiality

We keep the business information you share with us confidential and use it only to do your work, unless you have made it public or the law requires us to disclose it.

9. Refunds

Monthly charges are not refunded for partial months, because design time is reserved for you from the start of each month. If we cannot deliver any work during a paid month because of a problem on our side, we will refund that month in full. For one-off projects, refunds follow the payment schedule in your quote.

10. Your account and acceptable use

Keep your sign-in details secure and tell us promptly if you think someone else has used your account. You agree not to misuse the site, including by attempting to access it in unauthorized ways, interfering with its operation or using automated tools to copy its content, and not to ask us to create work that is unlawful or infringes anyone else’s rights.

11. Warranties

We perform our work with reasonable skill and care. Apart from that and from any warranties that cannot be excluded by law, the site and our services are provided “as is” and we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, Atlas Analytics LLC is not liable for any indirect, incidental, special or consequential damages, or for lost profits, arising from your use of the site or our services. Our total liability for any claim relating to a plan or project is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. If a problem comes up, please contact us first; most issues are resolved quickly by email. Any dispute that cannot be resolved informally may be brought in the state or federal courts located in New Castle County, Delaware, or, where eligible, in small claims court in the county where you live.

14. Changes to these Terms

We may update these Terms from time to time. For subscribers, we will email you about material changes at least 30 days before they apply to your plan.
